Terms & Conditions of the DhuMall Social Media Growth Kit

These Terms & Conditions (“T&C”) govern the DhuMall TikTok Collab (the “Services”) provided by DhuMall (“Service Provider”) to the Client.

By signing up or making a payment, the Client agrees to these T&C.

  1. Service Scope
    • Services include Single Post Promotion, Campaign Package, and Product Seeding.
    • Services are limited to the TikTok platform only.
    • The Service Provider will coordinate TikToker selection, content guidelines, and posting schedule monitoring only.
    • Campaign durations typically range from 2 weeks (Basic) to 8 weeks (Premium), depending on package selection and campaign objectives.
    • DhuMall does not guarantee specific engagement metrics (e.g., number of views, likes, or followers), as these are dependent on TikTok’s algorithm and audience behavior.
  1. Fees and Payment
    • Fees are charged based on the selected package (Basic, Standard, or Premium).
    • Full payment is required before the campaign starts.
    • All fees are non-refundable, except in the case of cancellation by DhuMall for reasons unrelated to Client performance.
    • Prices are exclusive of applicable taxes (if any).
    • Payment constitutes acceptance of all terms stated herein.
  1. Recurring Subscription & Cancellation
    • The TikTok Collab is offered on a monthly subscription basis.
    • After the initial month, your subscription will automatically renew for subsequent months at the same package level, unless you cancel prior to the renewal date.
    • You may cancel your subscription at any time. Cancellation requests must be submitted via email to
       enquiries@dhumall.com or through the designated client portal.
    • Upon cancellation, your subscription will remain active until the end of the current billing cycle; no further charges will be applied.
    • Refunds are not provided for partial months already billed.
    • DhuMall reserves the right to adjust subscription fees for future periods; any changes will be communicated at least 30 days in advance.
  1. Client Responsibilities
    • Provide accurate product information, branding assets, and campaign brief on time.
    • Provide timely feedback for the content approval stage.
    • Ensure products are legally compliant and safe for promotion in Malaysia, excluding but not limited to tobacco, alcohol/liquor, drugs, vapes, weapons, and any illegal or restricted items.
    • Client is responsible for ensuring any necessary advertising or promotional approvals from relevant Malaysian authorities (e.g., MCMC, KPDN).
    • The Client will monitor TikTok analytics (views, reach, engagement) directly; DhuMall will not access or manage the Client’s TikTok account.
  1. Content Approval & Intellectual Property
    • Clients may approve or request minor adjustments to content before posting.
    • All TikToker-generated content remains the property of the respective TikToker.
    • The Client is granted a non-exclusive, limited right to repost or share the TikToker’s content only with the TikToker’s written consent (consent is to be obtained from DhuMall).
    • DhuMall may use anonymized or aggregated campaign data and results for internal reporting, marketing, or case studies.
  1. Limitation of Liability
    • DhuMall assumes no responsibility or liability for any losses, damages, delays, errors, or failures arising from or in connection with the Services, including but not limited to:
      • Actions, omissions, or content posted by TikTokers
      • TikTok platform restrictions, outages, or policy changes
      • Any direct, indirect, incidental, or consequential loss or damage
      • Performance or success of the campaign outcomes
    • The Client acknowledges that results are not guaranteed and that DhuMall’s role is limited to coordination and facilitation.
    • To the fullest extent permitted by law, DhuMall’s maximum aggregate liability shall not exceed the total fees paid by the Client for the Services.
  1. Confidentiality
    • Both parties agree to maintain the confidentiality of any non-public, proprietary, or sensitive information disclosed during the campaign.
    • DhuMall will not disclose Client brand or campaign details to third parties without prior written consent, except as required by law or regulatory authorities.
  1. Termination
    • DhuMall reserves the right to terminate or suspend the campaign if the Client fails to provide required materials, approvals, or payment.
    • Upon termination, all fees paid are non-refundable.
    • Either party may terminate this Agreement in writing if the other party breaches these T&C and fails to remedy such breach within seven (7) days of written notice.
  1. Force Majeure

DhuMall shall not be held liable for any delay or failure to perform its obligations due to circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, platform restrictions, government actions, or system outages.

  1. Governing Law & Jurisdiction
    • These Terms & Conditions shall be governed by and construed in accordance with the laws of Malaysia.
    • Any disputes arising out of or relating to these T&C shall be subject to the exclusive jurisdiction of the courts of Malaysia.
  1. Acceptance of Terms

By signing up, submitting campaign details, or making a payment, the Client acknowledges that they have read, understood, and agreed to these Terms & Conditions in full.
