Government Grants Services Terms & Conditions
These Terms and Conditions (“Terms”) govern the participation and purchase of the Government Grants Services (“Program”) offered by DhuMall (“DhuMall”, “we”, “our”, or “us”). By enrolling in or purchasing the Program, you (“Client”, “Participant”, “you”, or “your”) agree to be bound by these Terms. Please read these Terms carefully before making your purchase.
- Program Overview
The Government Grants Services program is a consultation and advisory service designed to help businesses identify, prepare for, and apply for suitable government grants.
The Program includes, but is not limited to:
- Onboarding (Consultation & Grant Alerts): Company background study, eligibility analysis, ongoing consultation, and grant notifications.
- Optional Add-On Packages, including:
• Grant Application Assistance (support in preparing and submitting applications)
• Grants Approved Reward (success-based commission upon grant approval)
• Compliance Support (reporting and documentation assistance post-approval)
• Additional optional services as may be introduced by DhuMall from time to time.
All inclusions, deliverables, and timelines are subject to modification or withdrawal at DhuMall’s discretion to ensure service quality and compliance with regulatory updates.
- Eligibility
The Program is open to registered businesses, corporations, and entrepreneurs.
By enrolling, you confirm that:
- You are legally authorized to represent your organization; and
- All information provided to DhuMall is true, accurate, and complete to the best of your knowledge.
- Program Fees and Payment Terms
- The Onboarding Fee is a non-refundable consultation fee, payable in full at the time of registration.
- This fee covers consultation, company analysis, and grant alert services for a one-year engagement period.
- Payment must be made through DhuMall’s approved payment methods (e.g., bank transfer, payment gateway, or invoice).
- Optional services such as Application Assistance, Approved Reward, or Compliance Support may incur additional charges as quoted by DhuMall.
- All quoted fees are exclusive of applicable taxes, unless stated otherwise.
- Program Delivery
Upon receipt of payment and confirmation of registration:
- DhuMall will initiate the Onboarding process within a reasonable timeframe, typically within 7–10 working days.
- The timeline of consultation and alerts may vary depending on your company’s readiness and response time.
- You must provide accurate information, financial or operational data, and other relevant materials for analysis and eligibility mapping.
- DhuMall reserves the right to adjust delivery schedules as necessary to maintain quality and reflect updates in grant program availability.
- Client Responsibilities
To ensure smooth delivery and successful outcomes, you agree to:
- Provide all required company information, supporting documents, and updates promptly.
- Notify DhuMall of any significant business changes that may affect eligibility (e.g., ownership, operations, financials).
- Review and approve materials in a timely manner when requested.
- Communicate with professionalism and maintain mutual respect during the engagement.
Delays or incomplete submissions by the Client may impact service timelines or outcomes. DhuMall shall not be held liable for such consequences.
- Intellectual Property Rights
- All methods, templates, tools, and materials developed by DhuMall remain the intellectual property of DhuMall unless otherwise agreed in writing.
- The Client retains ownership of their own company information, trademarks, and proprietary content provided for the Program.
- By enrolling, you grant DhuMall a non-exclusive, royalty-free license to use your company name and logo solely for internal reference, service execution, or marketing showcase (unless otherwise requested in writing).
- Confidentiality
Both DhuMall and the Client agree to treat all proprietary and sensitive information shared during the Program as strictly confidential, and to use it only for purposes directly related to the Program.
Disclosure to third parties is prohibited without prior written consent, except as required by law.
- Limitation of Liability
To the fullest extent permitted by law:
- DhuMall, its directors, officers, employees, agents, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages (including, without limitation, loss of profits, opportunities, business, goodwill, or data) arising out of or in connection with the Program, its services, or these Terms, whether in contract, tort (including negligence), strict liability, or otherwise.
- DhuMall provides consultation and advisory services only and does not guarantee grant approvals, funding outcomes, or specific financial results, as all final decisions rest solely with government agencies or funding bodies.
- In all circumstances, DhuMall’s total aggregate liability shall not exceed the total amount paid by the Client for the Program
- Refund & Cancellation Policy
- All payments made are non-refundable.
- If you fail to provide necessary materials or choose to withdraw, no refund or credit will be issued.
- In exceptional circumstances (e.g., discontinuation of the Program by DhuMall), partial refunds or service credits may be offered at DhuMall’s sole discretion.
- Modifications to the Program
- DhuMall reserves the right to modify, suspend, or discontinue any aspect of the Program, including pricing, scope, or inclusions at any time without prior notice.
- Any material updates will be communicated via email or published on DhuMall’s official website.
- Indemnification
You agree to indemnify, defend, and hold harmless DhuMall, its affiliates, and personnel from and against any claims, liabilities, losses, or expenses (including legal fees) arising from:
- Your breach of these Terms;
- Misrepresentation or misuse of information provided under any grant program; or
- Violation of applicable laws or third-party rights.
- Data Protection & Privacy
DhuMall complies with the Personal Data Protection Act 2010 (Malaysia) and applicable international data protection regulations (including GDPR).
- Client information is collected and used solely for the purpose of service delivery, communication, and Program improvement.
- DhuMall employs reasonable measures to protect data from unauthorized access.
- By enrolling, you consent to the collection and processing of your data in accordance with DhuMall’s Privacy Policy available on its official website.
- Marketing Consent
By participating in the Program, you consent to:
- Receiving updates, alerts, and promotional materials from DhuMall via email or other communication channels; and
- DhuMall referencing your company’s participation in client portfolios or case studies (unless you request otherwise in writing).
You may withdraw your consent anytime by contacting enquiries@dhumall.com or using the unsubscribe option in our communications.
- Force Majeure
DhuMall shall not be held liable for any delay or failure in performing its obligations due to causes beyond its reasonable control, including but not limited to natural disasters, acts of government, war, strikes, pandemics, or system failures. In such cases, DhuMall may extend service timelines or temporarily suspend performance without liability.
- Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Malaysia.
Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
