These Terms and Conditions (“Terms”) govern the purchase and use of the Lead Boost and Email Campaigns (“Program”) offered by DhuMall (“DhuMall”, “we”, “our”, or “us”).

By purchasing or using the Program, you (“Client”, “Participant”, “you”, or “your”) agree to be bound by these Terms. Please read carefully before making your purchase.

1. Program Overview

The Program is designed to help businesses generate qualified leads and run effective email marketing campaigns. The Program may include, depending on your chosen package:

• • Qualified leads (B2B & B2C)
  • Ready-to-send email templates and follow-up sequences
  • Campaign strategy calls
  • Lead segmentation by industry, location, or other criteria
  • Reporting and analytics (bi-monthly or weekly depending on package)
  • Email integration using professional business email/domain

All inclusions, features, timelines, and offers are subject to modification at DhuMall’s discretion. Enterprise packages are fully customized based on business needs.

2. Eligibility

The Program is available to registered businesses, entrepreneurs, and individuals managing business accounts. You confirm that:

• • You are legally authorized to represent your business or organization.
  • All information provided to DhuMall is accurate, current, and complete.

3. Program Fees and Payment Terms

• • Full payment is required at the time of registration.
  • Payment must be made via DhuMall-approved methods (bank transfer, online payment gateway, or invoice).
  • All payments are non-refundable, except in exceptional circumstances as determined by DhuMall.
  • Fees are exclusive of any applicable taxes unless stated otherwise.

4. Recurring Subscription & Cancellation

• • The Program is offered on a monthly subscription basis.
  • After the initial month, your subscription will automtically renew at the same package level unless cancelled prior to renewal.
  • You may cancel at any time by emailing enquiries@dhumall.com or via the client portal.
  • Upon cancellation, your subscription will remain active until the end of the current billing cycle; no further charges will apply.
  • Refunds are not provided for partial months already billed.
  • DhuMall reserves the right to adjust subscription fees for future periods; any changes will be communicated at least 30 days in advance.

5. Program Delivery

• • Services commence after full payment and registration confirmation.
  • Typical delivery timelines depend on the package selected:
    • Lead generation (qualified leads) is delivered as per the package limit.
    • Email templates, follow-up sequences, and reports are delivered according to the schedule for your chosen package.
  • Enterprise packages may vary depending on volume, customization, and client requirements.
  • Delivery includes all relevant leads, email templates, follow-up sequences, reporting, and strategy calls.
  • Timelines may be adjusted to ensure quality or due to client delays.

6. Client Responsibilities

To facilitate smooth delivery, you agree to:

• • Provide all required company information, leads, email lists (if applicable), and approvals promptly.
  • Review and provide feedback on templates, sequences, and reports within requested timelines.
  • Conduct communications professionally with DhuMall.

Failure to provide materials or approvals on time may delay delivery; DhuMall is not liable for delays caused by client inaction.

7. Intellectual Property Rights

• • DhuMall retains ownership of all templates, email sequences, campaigns, and content produced.
  • Clients retain ownership of their logos, trademarks, and proprietary materials provided.
  • By participating, you grant DhuMall a non-exclusive, royalty-free, worldwide license to use your business name, logo, and materials for program execution and promotional purposes.

8. Confidentiality

Both parties agree to maintain the confidentiality of all proprietary and sensitive information shared during the Program. Disclosure to third parties requires written consent, except as required by law.

9. Limitation of Liability

• • DhuMall and its affiliates are not liable for any direct or indirect damages, including loss of revenue, profits, or goodwill.
  • Results, including leads generated, email engagement, or conversions, are not guaranteed.
  • Participation is at your own discretion and risk.
  • DhuMall’s total liability shall not exceed the total amount paid by you for the Program.

10. Refunds & Cancellation Policy

• • All payments are non-refundable.
  • Failure to provide required materials or voluntary withdrawal does not entitle you to a refund or service credit.
  • In rare cases (e.g., Program cancellation by DhuMall), partial refunds or credits may be offered at DhuMall’s discretion.

11. Modifications to the Program

DhuMall reserves the right to modify, suspend, or discontinue any part of the Program, including features, timelines, or inclusions, at any time. Material changes will be communicated via email or the official website.

12. Indemnification

You agree to indemnify and hold harmless DhuMall and its affiliates from any claims, damages, or expenses arising from:

• • Breach of these Terms
  • Misuse of Program content or leads
  • Violation of laws or third-party rights

13. Data Protection & Privacy

DhuMall complies with applicable data protection laws (including Malaysia PDPA and GDPR).

• • Personal and company data is collected and used solely for Program delivery, communications, and related marketing purposes.
  • Reasonable security measures are implemented to protect your data.
  • By enrolling, you consent to data processing per DhuMall’s Privacy Policy.

14. Marketing Consent

By participating, you consent to:

• • Receiving updates, promotional materials, and communications from DhuMall.
  • DhuMall referencing your business as part of its client portfolio or marketing showcases.

Consent can be withdrawn anytime via enquiries@dhumall.com.

15. Force Majeure

DhuMall is not liable for delays or failures caused by events beyond its reasonable control, including natural disasters, strikes, government actions, pandemics, or system failures. Delivery timelines may be extended as necessary.

16. Governing Law & Jurisdiction

These Terms are governed by Malaysian law. Any disputes fall under the exclusive jurisdiction of Malaysian courts.
