Terms & Conditions of the DhuMall Social Media Growth Kit

These Terms and Conditions (“Terms”) govern the purchase and use of the Social Media Growth Kit (“Program”) offered by DhuMall (“DhuMall”, “we”, “our”, or “us”).

By purchasing or using the Program, you (“Client”, “Participant”, “you”, or “your”) agree to be bound by these Terms.

Please read carefully before making your purchase.

 

  1. Program Overview

The Social Media Growth Kit is a content creation and social media management service designed to help businesses increase their online visibility, engagement, and conversion through ready-to-post content, graphics, captions, and strategy.

The Program may include, depending on your chosen package:

    • Social media posts for selected platforms (Facebook, Instagram, LinkedIn, TikTok/Reels)
    • Custom graphics and video content
    • Captions and call-to-actions optimized for engagement
    • Hashtag strategy and posting guides
    • Engagement starter tips and templates
    • Scheduling assistance (Premium/Enterprise tiers)

All inclusions, features, timelines, and offers are subject to modification at DhuMall’s discretion.

 

  1. Eligibility

The Program is available to registered businesses, corporations, entrepreneurs, and individuals managing business accounts.
By enrolling, you confirm that:

    • You are legally authorized to represent your business or organization.
    • All information provided to DhuMall is accurate, current, and complete.

 

  1. Program Fees and Payment Terms
    • Full payment is required at the time of registration.
    • Payment must be made via DhuMall-approved methods (bank transfer, online payment gateway, or invoice).
    • All payments are non-refundable, except in exceptional circumstances as determined by DhuMall.
    • Fees are exclusive of applicable taxes unless stated otherwise.

 

  1. Recurring Subscription & Cancellation
    • The Social Media Growth Kit is offered on a monthly subscription basis.
    • After the initial month, your subscription will automatically renew for subsequent months at the same package level, unless you cancel prior to the renewal date.
    • You may cancel your subscription at any time. Cancellation requests must be submitted via email to enquiries@dhumall.com or through the designated client portal.
    • Upon cancellation, your subscription will remain active until the end of the current billing cycle; no further charges will be applied.
    • Refunds are not provided for partial months already billed.
    • DhuMall reserves the right to adjust subscription fees for future periods; any changes will be communicated at least 30 days in advance.

 

  1. Program Delivery
    • Services commence after receipt of full payment and confirmation of registration.
    • Typical delivery timeline for content is 14 business days, unless otherwise agreed (Enterprise tier may vary).
    • Delivery includes content assets, graphics, captions, CTAs, posting guides, and other features based on the package selected.
    • Timelines may be adjusted to ensure quality, coordination, or due to client delays.

 

  1. Scope LimitationThe Social Media Growth Kit provides content creation services only. DhuMall does not provide engagement management (comment replies, DMs), ads management, live monitoring, or posting unless explicitly stated in your package.

 

  1. Client Responsibilities

To facilitate smooth delivery, you agree to:

    • Provide all required branding materials, assets, and approvals promptly.
    • Review and provide feedback on content within requested timelines.
    • Ensure professional and accurate communication with DhuMall.

Failure to provide materials or approvals on time may delay delivery. DhuMall is not liable for delays caused by client’s inaction.

 

  1. Intellectual Property Rights
    • All intellectual property in content, graphics, campaigns, and materials created by DhuMall remains the property of DhuMall unless otherwise agreed in writing.
    • Clients retain ownership of their logos, trademarks, and proprietary materials provided to DhuMall.
    • By participating, you grant DhuMall a non-exclusive, royalty-free, worldwide license to use your business name, logo, and materials solely for program execution and promotional purposes.

 

  1. Confidentiality

Both parties agree to maintain the confidentiality of all proprietary and sensitive information shared during the Program. Such information shall not be disclosed to third parties without prior written consent, except as required by law.

 

  1. Limitation of Liability

To the fullest extent permitted by law:

    • DhuMall and its affiliates, officers, and employees shall not be liable for any direct or indirect damages, including loss of revenue, profits, or goodwill.
    • While we provide marketing and content services, results (followers, engagement, or sales) are not guaranteed.
    • Participation is at your own discretion and risk.
    • DhuMall’s total liability shall not exceed the total amount paid by you for the Program.

 

  1. Refunds & Cancellation Policy
    • Payments are non-refundable.
    • Failure to provide required materials or voluntary withdrawal does not entitle you to a refund or service credit.
    • In rare cases (e.g., Program cancellation by DhuMall), partial refunds or service credits may be offered at DhuMall’s sole discretion.

 

  1. Modifications to the Program

DhuMall reserves the right to modify, suspend, or discontinue any part of the Program, including pricing or features, at any time without notice. Material changes will be communicated via the official website or email.

 

  1. Indemnification

You agree to indemnify, defend, and hold harmless DhuMall and its affiliates from any claims, damages, or expenses arising from:

    • Breach of these Terms
    • Misuse of Program content
    • Violation of laws or third-party rights

 

  1. Data Protection & Privacy

DhuMall complies with applicable data protection laws (including Malaysia’s PDPA and GDPR).

    • Personal and company information will be collected and used solely for Program delivery, communication, and related marketing purposes.
    • Reasonable security measures are implemented to protect your data.
    • By enrolling, you consent to data processing per DhuMall’s Privacy Policy.

 

  1. Marketing Consent

By participating, you consent to:

    • Receiving updates, promotional materials, and communications from DhuMall.
    • DhuMall referencing your business as part of its client portfolio or marketing showcases.

Consent can be withdrawn at any time via enquiries@dhumall.com.

 

  1. Force Majeure

DhuMall is not liable for delays or failures caused by events beyond its reasonable control, including natural disasters, strikes, government actions, pandemics, or system failures. Delivery timelines may be extended as necessary.

 

  1. Governing Law & Jurisdiction

These Terms are governed by the laws of Malaysia, and any disputes will fall under the exclusive jurisdiction of Malaysian courts.
