Terms & Conditions of the DhuMall WhatsApp Business Boost
These Terms & Conditions (“Terms”) govern the use of the DhuMall WhatsApp Business Service (“Service”) provided by DhuMall (“DhuMall”, “we”, “us”, or “our”) to the subscribing client (“Client”, “you”, or “your”). By subscribing to or using this Service, you agree to be bound by the following Terms.
- Definitions
- Service refers to the DhuMall WhatsApp Business Service, which may include account setup, message automation, broadcast management, and related support.
- Client refers to the business entity or individual subscribing to the Service.
- Platform refers to DhuMall’s managed or hosted system through which the Service is provided.
- Acceptance of Terms
By registering, subscribing, or making payment for the Service, the Client acknowledges that they have read, understood, and agree to abide by these Terms & Conditions and any related policies issued by DhuMall.
- Scope of Service
The Service enables clients to use WhatsApp Business messaging via DhuMall’s platform or integrated API solutions.
DhuMall reserves the right to enhance, modify, or discontinue any aspect of the Service at any time without prior notice.
- Client Obligations
The Client shall:
- Provide accurate and complete business information.
- Use the Service solely for lawful business communications.
- Do not use the Service for spam, scams, or content violating WhatsApp’s or DhuMall’s usage policies.
DhuMall reserves the right to suspend or terminate access for any misuse.
- Fees and Payment
- All payments must be made in full before service activation.
- Strictly no refund will be issued once payment is made, regardless of non-usage, service interruption, or early termination.
- DhuMall reserves the right to suspend or terminate the Service for overdue or incomplete payments.
- Service Limitation
- The Service is provided on an “as is” and “as available” basis.
- DhuMall does not guarantee uninterrupted access, message delivery success, or compatibility across all devices or networks.
- Performance may depend on third-party systems such as Meta’s WhatsApp Cloud API.
- Exclusion of Liability
- To the fullest extent permitted by law, DhuMall excludes all liabilities for any loss, damage, or interruption (direct, indirect, consequential, or special) arising from the use or inability to use the Service.
- DhuMall shall not be held responsible for failures, delays, or disruptions caused by third-party providers or external factors beyond its control.
- Disclaimer on Service Outcomes
- DhuMall provides the WhatsApp Business Service as a communication and automation tool only. While the Service is designed to enhance engagement and operational efficiency, DhuMall makes no guarantee or representation regarding specific business outcomes, including but not limited to increased sales, lead generation, customer retention, or revenue growth.
- The Client acknowledges that actual results depend on multiple factors beyond DhuMall’s control, such as market conditions, product or service quality, marketing strategies, and customer behavior. Therefore, DhuMall shall not be held responsible or liable for the business performance, financial outcome, or return on investment resulting from the use of this Service.
- Intellectual Property
- All materials, systems, and configurations developed or provided by DhuMall remain the property of DhuMall.
- The Client is granted a limited, non-transferable right to use the Service during the subscription period.
- Confidentiality and Data Protection
- DhuMall will take reasonable measures to safeguard Client data but shall not be liable for data breaches beyond its control.
- Both parties shall comply with the Personal Data Protection Act 2010 (PDPA) of Malaysia.
- Termination
- DhuMall may suspend or terminate the Service at any time for breach of these Terms, unlawful use, or reputational harm.
- Upon termination, Client access may be revoked and data may be deleted without notice.
- Indemnity
The Client agrees to indemnify and hold harmless DhuMall, its officers, and employees from any claims, damages, or liabilities arising from misuse or unlawful use of the Service.
- Force Majeure
DhuMall shall not be held liable for any delay or failure to perform due to causes beyond its reasonable control, including but not limited to natural disasters, network outages, or government actions.
- Amendments
DhuMall reserves the right to amend these Terms & Conditions at any time. Continued use of the Service following such amendments shall constitute acceptance of the revised Terms.
- Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the Laws of Malaysia.
Any disputes arising shall be subject to the exclusive jurisdiction of the courts of Malaysia.
- Acknowledgement and Acceptance
By making a payment for the DhuMall WhatsApp Business Service, the Client acknowledges that they have read, understood, and fully accepted all the terms and conditions contained in this Agreement.
